공공갈등 조정의 성공 요인 분석

초록

본 연구는 1990년대 이후 한국에서 조정을 통해 해결된 6건의 공공갈등 사례를 분석하고, 성공적인 조정에 영향을 미친 요인을 도출하였다. 조정의 성공 수준은 당사자간 이해관계의 균형있는 반영 여부를 기준으로 타협, 부분 상생, 완전 상생의 3단계로 구분하였다. 분석 결과, 첫째, 조정자의 전문성과 신뢰성이 매우 중요한 영향요인으로 나타났다. 조정자의 전문성과 신뢰성이 매우 낮을 때 타협, 둘 다 중간일 때 부분 상생, 둘 다 중간 또는 매우 높을 때 완전 상생의 결과를 가져왔다. 둘째, 당사자 수의 영향은 낮은 것으로 나타났다. 이는 6개 갈등 사례에 한정된 분석결과이고, 특히 당사자의 수가 4명인 경우 타협의 결과를 보였다는 점에서 일반화에 주의가 필요하다. 셋째, 갈등 기간의 영향도 상대적으로 작은 것으로 나타났으나 갈등 기간이 갈등의 성숙도와 조정의 필요성 인식에 영향을 미치는 만큼 신중한 해석이 필요하다. 넷째, 갈등유형의 효과도 미미하였는데, 선정된 6개 사례 모두 이익 갈등 또는 이익과 가치의 혼합 갈등으로서 순수한 가치 갈등이 포함되지 않아 갈등유형의 효과가 제대로 파악되지 않았다고 할 수 있다.

Abstract

The study analyzed six cases of public conflicts that have been resolved through mediation in South Korea since the 1990s and derived the factors that influenced the successful mediation. The level of mediation was divided into three levels: compromise, partial win-win, and complete win-win according to whether the mediation proposal reflected the interests of the parties in a balanced manner. The results of the analysis included, first, the professionalism and reliability of the mediator were found to be important factors. It resulted in a compromise if the expertise and credibility of the mediator were very low, in a partial win-win if both were at a moderate level, and it resulted in a complete win-win if either factor was at an upper or intermediate level. Second, the number of parties was found to have a low impact on the quality of mediation. This is a limited analysis of six cases of conflict so caution should be exercised in generalizing the compromise results, especially in cases where the number of parties was very large. Third, the impact of the duration of the conflict was also found to be relatively small, but it needs to be interpreted carefully as the duration of the conflict affects the maturity of the conflict and the perception of the need for mediation. Fourth, the effect of the conflict type was also found to be insignificant, and all six selected cases were conflicts of interest or a mixture of interests and values, and did not include any pure value conflicts, so it can be said that the effects of the conflict types were not properly understood.
